Digital sovereignty becomes operational risk: SCOTUS FTC ruling meets EU Tech Sovereignty Package (news-pegged). Image: EU Commission slide.
Digital sovereignty is easy to admire and easier to defer.
It is a phrase European leaders reach for at conferences and forget on the way back to their offices, where their data still sits on a US cloud, and the AI runs on American models.
The arrangement that made the deferral comfortable is the EU-US Data Privacy Framework. In simple terms, it is one of the mechanisms that lets European personal data flow to certified US companies on the understanding that it receives essentially equivalent protection.
That understanding leans heavily on American institutional safeguards, including the Federal Trade Commission (FTC) as an independent privacy enforcer.
A US Supreme Court ruling has now put that independence in serious doubt. The pillar has not fallen, but it has a significant crack, and this is the same class of legal assurance that two previous EU-US transfer frameworks failed to survive.
So a dependency that many European businesses take for granted is now a live legal risk again.
And it surfaces in the same month the European Commission launches a Technological Sovereignty Package covering cloud, AI, semiconductors and open source. The timing is difficult to wave away.
Sovereignty has moved from a slogan you could nod at to a continuity question your company may need to answer.
Should we tear every American tool out of our infrastructure by Friday? No. That would be expensive, chaotic and probably impossible for most firms.
But do you know where your data and workloads actually sit? What vendors, models and cloud regions do they depend on? Which transfers rest on a legal basis that has failed twice and is now being challenged again?
Build the option to move before you are forced to, not after.
Digital sovereignty is no longer just about values. It is about whether your business has a plan B.
